The new Seller Disclosure Scheme officially kicking in from 1 August 2025 as part of the Property Law Act 2023. 

 

Whether you’re selling, buying, or advising someone who is, this new legislation is something you’ll want to understand before signing on any dotted lines. 

 

So, what is the Seller Disclosure Scheme? 

 

Put simply, sellers will soon be legally required to provide a clear, standardised disclosure statement to buyers BEFORE a contract is signed. 

 

That means no more confusion, inconsistent paperwork or last-minute surprises. It’s all about transparency and protecting both parties. 

 

What needs to be disclosed? 

 

The disclosure must include important facts about the property including things that might impact a buyer’s decision. 

 

Depending on the property type, this may cover: 

 

  • Title and zoning information 
  • Encumbrances (like easements or covenants) 
  • Flooding and environmental risks 
  • Body corporate details (if applicable) 
  • Building or compliance notices 
  • Council approvals or restrictions 

 

And more (especially for strata and community title schemes).
